10 Year Long Residency Refused. No Right of appeal.

Dear Sirs

I would be really grateful to you if you read my post and advise.

* first visa 2006 till 2008. Tier 4 Granted

* 2008 till 2010 Granted tier 4

* 2010 i had applied my visa but my payment was declined for some security reason and home office sent my application back to me for re-apply. I have applied after 42 days. Had no idea i have broken the section 3c. ( gave them reason why i have applied after 42 days. uni exams, passport expire etc etc)

* 2010 visa granted till 2011

* 2011 till 2103 PSW granted

* 2013 till 2016 Tier 1 Granted
Apply for the extension and variation for the ILR 10 year basis

* 2016 applied my 10 year long residency but refused because of above matter in 2010. NO RIGHT OF APPEAL GIVEN.( APPLIED WITH ONE DEPENDENT)

* APPLIED Tier 1 extension again to save my wife's 10 years application which is due on July 1 ( she came 2007 july)

* On other hand i have applied for PAP. Home office consider my application and ask for the evidence. They said we have to check your MARCH-April 2010 Bank statement to see if you had enough funds the time your payment been declined. I have sent them the proof of my bank statement and there was enough funds in my account. They said we will decide your application in 4 moths time.

I have family and kids and i know its hard time and i have to fight for my rights.

Your advise will be appreciate.

You do not have 10 year lawful residence as per definitions and rules. HO might apply discretion but that's that

ILR HAS BEEN GRANTED. ALWAYS FIGHT FOR YOUR RIGHT. THANKS ZIMBA FOR YOUR ADVISE.........
