ILR - Tier 2 Absences from UK

Hi
I am new on this forum and not sure where to post my question? So, please bear with me!
I am on Tier 2 visa and would be eligible to apply for ILR next month. I have been working for same employer throughout this time and will still be required for the same job.
I have a straight forward application with two ambiguities and I am really paranoid person so would like to get an answer please :)

My first Tier 2 visa was first granted on 13-08-2012 and I arrived in UK on 17-08-2012 (3 days after). Do I qualify on 13-08-2017 or 17-08-2017?

I left UK on 9th September 2012 and could not come back until 3rd January 2013. The reason of my absence for these three months (109 days in total) was out of my control. It was very personal and alot of disputes within family which I can explain in my letter to the immigration officer. I was continuously paid throughout this time because my employer was very much understanding!. Do you think it will be a problem? I can only write and explain in the letter of those circumstances.
Rest of the the five years I have been out of country for some business trips and annual holidays - all within allocated annual holiday allowance (maximum 40 days every year including business trips).

You will be eligible 28 days before completing your full 5 years from the issue date of your initial visa. Your employer letter must explain ALL your absences from the UK including the extended absence you had. They must confirm that absences were approved by them and you were paid regularly during those periods.
