Tier 1 Entrepreneur Dependent ILR Question

Hi,

I have few questions related to My Tier 1 Entrepreneur Dependent ILR application. My visa time line is;

Main Applicant

50K Route

Initial application granted in September’2013

Visa Extension granted on May’ 2017

Visa expiry date May’2019

I am planning to apply for ILR in next year September’ 2018 after completing 2 full time employments and 5 years period.

Dependent

Initial visa granted in July’2014

Visa extension granted on May’2017

Visa expiry date May’ 2019

My Questions

1. Can my dependent apply for ILR with me? (It will be 4 years and 2 months in UK for my dependent in September’ 2018.

2. What other options we will have if my dependent cannot apply for ILR at same time.

3. My Baby was born in UK in September’2016 baby does not have visa, have not travelled outside UK. Should we apply ILR application for him.

4. Can we apply Direct BC for baby after getting ILR.

5. Does my Dependent need English Language test before applying for ILR.

I will appreciate if zimba88 and other senior members help me to get those answers.

1. No. Dependent needs 5 years residence calculated from the date of entry to the UK.

2. Depends what date dependent entered the UK on whether a PBS extension is needed.

3. Apply to register as British citizen??

4. Yes once you have ILR.

5. Yes B1 English and life in the UK test.

Dear CR001,

I think the ILR 5 years is from the date of entry clearance being issued.
The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period. Any absences between the date of issue and entry to the UK are considered an allowable absence. This period will count towards the 180 days allowable absence in the relevant 12 month period.

If the delay is more than 180 days, you can only include time after the applicant entered the UK in the continuous period calculation.
Please correct me if I am wrong?

ILR 5 years period for PBS DEPENDANTS starts from the date of entry to the UK :!:

Dependent Visa was issued in 9 July'2014, Dependent came into UK 4th of August' 2014.

Few more questions Please

1. Can I apply PBS dependent visa for my dependent when I am applying ILR visa for myself in September' 2018, because dependent visa will expire in May 2019.

2. and Can my dependent apply ILR visa in August' 2019 (After completing 5 years stay in UK)

Yes, your dependent can apply for a PBS Dependent extension after you get ILR. It will be an application for 3 years and you will also have to pay the immigration health surcharge of £600 PLUS the visa fee

Yes, no sooner than within 28 days of 4th August 2019.
