Tier 1 Entrepreneur to ILR

Hello friends,

I've been on this forums on and off for a while and found the answers very helpful, and thanks for that.

Next week I am posting my ILR application on the basis of 5 year in Tier 1 Entrepreneur route.

I am a bit confused about some sections of the application form, I appreciate if you guys can help.

First of all, I am director of 2 companies, one company is holding company which is parent of the other company.

All of the job creation and activity was done through the child company only, should I submit any documents from the parent company even though there was no trade in there?

Question about income in ILR form

Hi again,

On the application form, section 5 ( Home and finances ) there is the following question:

5.3 Are you working in the UK?

If so, what is your pay each month after income tax and other deductions?

I take £1000 a month salary and different amounts of dividends once a while, so what should I put here?

Please advice.

Please ask all your ILR related question in this thread only :!:

You need to have been the director of the company that hired the employees. You need current appointment report from the 2nd company showing your name as the director.

Total sum of money after tax deductions in the last 3 months. Better send 3 months payslip or any other proof

Thanks a lot, first question is clear,

Regarding the income, I did not take dividends regularly, does it works if I add up dividends + salary of last year , deduct all taxes and then divide it by 12 months to work out monthly income?

I have also a letter from my accountant confirming this, what do you think?

Focus on the last three months only. There is no income requirement for Tier 1E ILR anyway. So the finances section is not that important to be honest so you should not take it too seriously

I have 2 more questions:

A ) under section 6 , immigration history

Should I list all of my holidays under absences table? I have left the UK and come back a couple of times during the past 8 years but I always had UK visa so there were no gaps. Maximum days I been away was 50 per year.

So basically is absences means every time you left the UK ( with or without uk visa ? ) or is it when you left the UK and you did not have a visa?

B) under X1 table where it says enter name of businesses which you are using to score points ( page 41 of Set O form ). Since I am in the Tier 1 extension already, there are the following sections:

Engaged in business activity
Job Creation
3 year accelerated route only
Investment in a UK business
Business registration
£5m turnover (if applicable )

Does it means I should only put company name and reg number in front of first 2 sections and leave the rest empty?

Sorry for the obvious questions but I am really stressed and applying next week :? :|

You should list ALL your absences from the UK in that last 5 years on Tier 1E visa
Fill all relevant parts of the table X1. You simply do not need to send evidence for your investment or registration within 6 months under 5 year settlement

I believe I still need to submit evidence for Part B ( Page 42 ) - Engaged in business activity at the time of the application.

What evidence should I submit from companies house?

A 'Current Appointment Report' dated within the 30 days of your application showing your name as a company director

Last question,

12E Tier 1 (Entrepreneur) migrant

For the period before you were granted leave as a Tier 1 (Entrepreneur) migrant, documents showing that you met the relevant requirements of the Immigration Rules.

What do I need to provide here as evidence?

What does it means? Anyone knows?

This is not relevant
