ILR through 5 year or 10 year route on different visas

My wife is on a Spousal visa that is up for renewal in January 2018. She has been on the Spouse/Partner Leave to Remain since June 2015. Prior to this, she was on a work permit (Tier 2) since 2012 and on a student visa (tier 4) between 2004 until 2012.

She didn't qualify under the 5 year or 10 year route previously as she had been out of the UK during most of her University holidays. But I assume she now would qualify for Indefinite Leave to Remain under the 5 year route if we count the last 5 years including the Spousal visa. Is this correct (i.e.she would qualify for ILR) or would she need to apply for the extension of the spousal visa for another 2.5 years?

Also, how many days in advance can she apply for the extension?

Your wife needs to have been resident in the UK for five years on a spousal visa to be able to apply for ILR. Five year routes generally do not allow for years to be aggregated across different visa types.

Any one can give me an idea of how long it can take to receive the biometric residence permit card if we use the premium service?

7 to 10 days.

Who is waiting for a biometric card??

Not waiting yet.. My wife's visa runs out on 17/1/18, so the earliest we can apply is the 20/12/17 but we want to book some holidays, expecting to fly out on 30/12/17. This would be too close and probably not going to work given 4 days lost from 23-26 December.

You would be cutting it too fine.

Suggest either postpone your holiday or go away earlier.
