ILR application for Tier 1 dependent

Hi, I entered the UK on ICT in July 2012 and my husband entered on Tier 1 General at the same time. I switched to my husband's Tier 1 visa as a dependent in December 2014.

My husband is now eligible for ILR. I understand that the ICT period is not counted towards the required 5 years for ILR.

Can I still apply for ILR along with him, as I have been in the UK, living with him for 5 years? We have rental agreements with our names on it to prove we have lived together for the last 5 years.

No you cannot. You will only qualify in 2019.

You need 5 years residence as PBS Dependent. You cannot combine different visa categories. Besides, ICT does not lead to ILR unless you apply for ILR based on 10 years long residence.

Thanks for your reply.

Can I apply for PBS Dependent after my husband gets his ILR or do I need to do it while he is still on Tier 1?
Also, is there a maximum period for which the extension is provided? I will need 2.5 years if I apply now to be eligible for ILR in December 2019

Yes after he gets ILR as long as you apply for an extension before your current visa expires.

An extension will be for 3 years. You cannot choose a lesser time. Immigration health surcharge of £600 will also have to be paid PLUS the visa fee.
