Eligible for ILR. LR??

Hi
my frnd came in uk in nov2008 on student visa but got married to a EU lady in 2015 now he got 5 years residents permit on base of marriage
Can he apply ILR on 10 years bases ???

He doesn't have 10 years residence yet so no, he can't.
What is his EU spouse doing in the UK as a qualified person?
What is your 'friends' full UK immigration history, including visa start and end dates??

He came as student in nov 2007 (not 2008) and remained on student visa till march 2015 , when HO gave him 60 days to find nrw college/uni meantime he got married to EU laday in march 2015....then he applied as Eu dependent which was refused and now he won appeal and got 5 years resident card ...... His 10 years wil complete in nov 2017 so can he apply for ILR LR ?
His wife is doing work through agency on and off and he has one daughter fron his EU wife

He will need to provide evidence of his EU wife being a qualified person exercising treaty rights for the WHOLE period that he is claiming as an EU spouse.
