Hello Guys,
I am Eligible to get my ILR in few more months. I have a below query:
I was away from UK for 51 calendar days continuously (During my 3rd year). Out of which 30 days are covered as part of my paid annual leave and i have been paid UK salary. For remaining 21 days i worked from india for the same UK client and i got Indian salary for 20 days. After that i came back to UK for same client and started getting my UK salary. Now what kind of letter or what reason i can mention for the 21 days i worked from india? Would this have any impact on my ILR ?
Note: I paid NI and Tax also for the month i was outside from this country .
Thanks

The 21 days you worked in India is quite similar to a business trip. So, in the employer letter, I would split this particular instance of absence into two - 30 days paid annual leave, and 21 days paid off-site work or something. I dont think there is any need to go too much into details about who paid etc. You can always clarify this with the case worker once you have submitted your application if at all they are unclear.

Under Tier 2 general, ALL absences including any business trips must be approved by your Employer.

Thanks Guys.. Lemme check if i can get that letter from employer. Because those 21 days i voluntarily worked from india due to some personal reasons. I am not sure if my company can give that as business trip letter.

Hello all,
In the below scenario did i broke the continuous period:
In the year 2015 i was outside UK for 50 Calendar days .The reason was, The Project i worked in UK had been completed and i moved to india for 50 calendar days. I had been issued P45 form by my sponsor. After 50 days I came back to UK through same sponsor and same visa and started working on a new project. Out of 50 days i have utilised 30 days as paid uk annual leave. remaining 20 days i worked from india for same sponsor and same project
My Queries are as follows:
1. As per the guidelines mentioned in Page 17 of the "Calculating-continuous-leave-v15.0.pdf" "Holidays taken on the conclusion of employment" Would this absence considered as a allowable absence. Do i need to produce any absence letters for the 50 Calendar days i was outside United Kingdom due to conclusion of employment ?At the end of 50 Calendar days I came back to UK for same sponsor.
2. IF i need to produce any absence letter , does the employer has to state anything specifically in that letter ?
