I am hoping to apply for ILR under the SET (M) application after completing to 5 year FLR(M) route as a partner.

I first entered the UK on 15 September 2011 on a TIER 4 Student visa - valid from 08/09/2011 to 25/01/2013
Meant my husband and were married 27 October 2012

My first FLR(M) Residence permit was from 23/11/2012 to 16/05/2015
My second FLR(M) Residence permit was from 08/05/2015 to 16/11/2017

I will be doing the premium service. So can I apply for a date that is within 28 days of 16 November 2017 (earliest being 19 October 2017)?

you can apply 28 days before 23 Nov. so around 26 Oct or later.

Correction. You can apply no earlier than 28 days before the 16th October 2017 and no later than the expiry date on your current FLR(M) visa.
