Hi All,

I am desperately looking for your advice. In next month I would be able to apply for ILR for 10 yrs route. But the main problem is i have convicted with non custodial sentence in December 2016. I have wife and a child here. I know i don't qualify for good character requirement.
2007: student visa
2009: extension to student visa
2011: tier 2 general
2013: another tier 2 general
2014: ontime flr O
2016: ontime set o
2017: refusal with no right of appeal. Within 10days another FLR HRO application

So can you please tell me which application should i use?
No ilr until 2018. But is there any visa they will give me that i can work here and run my family?

Thanks in advance. Any answer will be appreciated.

A non custodial conviction will lead to a an automatic refusal for ILR within the next 24 months making it impossible to get ILR until Dec 2018.
Why did your SET(O) fail in the first place ??

Thank you for your kind reply. I understand that i can't apply for ilr within 24 months of the conviction date. But to get any kind visa now which application should i use?
Set(O) reason of refusal: convicted, not here for 10years and child is not here for 7years because he was 2 years old.
My current application has applied on May 2017 on flr(HRO). In November it would be 6months. Now when i check online on home office website, it says "Awaiting a decision" which is updated on 17th of August. What should i do now?

You cannot do much. You have been overstaying here which means you cannot apply for ILR anymore unless your FLR is successful. Unfortunately you seem to have no strong basis to gain a residence here.
