Dear All,
I have a question regarding Tier 2 to ILR salary requirement, To eligible for ILR is 35000. But I am confused:) and I can't find any related document on the UKBA website.

If the employee does need to earn 35000 for all 5 years?

OR

In the last 5th year? (In last 12-month payslip)

OR

At the time of ILR application (only last month Payslip)?

Need your opinion and advice...
Many Thanks

It is at the time of ILR application.

You should note that any sudden large increase just before ILR will be a red flag to HO and they are investigating all these cases.

Thanks For your reply.

If sudden increase will be a red flag to Home Office! then is it ok to apply Tier 2 ILR on the end of 6th year? Because I have already got a 1-year extension.

What is your current salary?

The minimum salary requirement goes up slightly every April.

Currently is 31500, but my employer is happy to match ILR requirement. and eligible to ILR in NOV 2017.
But by the end of next year Nov 2018 my Salary should be increment 36000.

But that increment is in 6th year so Is it ok to apply ILR on end of 6th year?

Yup, April 2018 it raises to £35,500pa so you should be good.

Also note that a £4,500pa increase could still raise a flag if no other employee got the same level of increase and your job role has not changed.

Could you please suggest me that is it ok to wait and apply ILR in next year 2018.
I already have 1 year extension on my current tier 2 visa, but I am not sure that I am eligible to apply ILR at end of tier 2 on 6th year.

Many Many thanks...

You can apply at any time. There is no rule that says it MUST be at the 5 year mark.

I have one more question can you please help me with this...

My tier 2 visa is applied by my sponsor on behalf of me so I don't know what SOC code they put, and they didn't provide me SOC letter.

Does that any way that I can find out my SOC code is on shortage occupation list or not?

You can ask your employer to provide you the SOC Code. There is no other way to find out.
