T1(E) Settlement Dependent

Dear Members

I am currently living in the UK as PBS dependant of my hubby.
My hubby is T1(E) visa now. His timeline is:

25/07/2012 --- 10/11/2015 T1(E)
10/11/2015 --- 10/11/2017 T1(E) Extension
10/11/2017 can apply T1(E) settlement

My timeline is:
01/12/2013 ---10/11/2015 T1 BPS DEP (23 months)
10/11/2015 ---10/11/2017 T1 BPS DEP Extension (24 months)

Question:
Can I apply T1(E) settlement as dependent with my hubby together ?
Or BPS DEP Extension?

The T1(E) settlement dependent guidance makes me confused:

You must also have been living with your partner in the UK for at least:
2 years if you applied for your current visa before 9 July 2012
5 years if you applied for your current visa on or after 9 July 2012

Question:
Can I apply T1(E) settlement as dependent with my hubby together ?
Or BPS DEP Extension?
You require 5 years residence as a PBS Dependent, counted from the date you entered the UK and not from your visa start date (if applied from abroad). So you will need an extension.
The T1(E) settlement dependent guidance makes me confused:

You must also have been living with your partner in the UK for at least:
2 years if you applied for your current visa before 9 July 2012
5 years if you applied for your current visa on or after 9 July 2012
Obviously 5 years as your visa was issued after 9th JUly 2012. Not sure what is confusing you in this statement from the guidance.
