ILR application - Short of 32 days

Hi Everyone ,
I came to UK in September 2009 for Masters and since then i have been in UK with the below work visa validity

Post study Work visa: 10-Feb-2011 until 10-Feb-2013
Tier 2 Sponsored (1st Time): From 25-Mar-2013 until 23-Feb-2016
Tier 2 Sponsored (2nd Time): 10-Feb-2016 until 23-Feb-2018

I thought my visa qualifying period for ILR should start from 11-Feb-2013 since Post study work visa expired on 10Feb2013 and i applied for Tier 2 sponsored visa on time before 10Feb2013.

1) Now If i consider 25-Mar-2013 as my start of 5 years on Tier 2, until 23 Feb2018, i am short of 32 days for 5 years completion

2) But if i consider 11-Feb-2013 as my start, my 5 years of qualifying period end is 10-Feb-2018

Need some inputs on how to proceed? Should I be applying for Extension of Sponsor Visa? Should i be applying for ILR by POST? or Can i apply for Same day application?

I am in a bit of panic on this discovery of just falling short for ILR.

If you post your application for ilr on 23 feb, before your visa expires, by the time they come around looking at it, you should be fine.

thanks for the response, however i have read on few cases where i need to have complete 5 year visa in order to be eligible and to apply before 28 day. in my current case, i do not have 5 years visa, it is short of 32 days which means i have to go for 3rd Tier 2 extension and i can apply within next week for ILR to be eligible.

28-Feb-2018 is the earliest i can apply for ILR as i understand.

Apply for ILR via post and by the time the application fee is deducted, you will be fully eligible for ILR.

Hello again,

Thank you for your time and responses.

I confirmed with the UKBA over phone and they said, i will need to have complete 5 years of visa without which i am not eligible to apply for ILR. Therefore i have to apply for a 3rd extension using sponsorship now and then after few days, i can apply for my ILR as i will meet the 5 year visa condition.

I hope this will be of help to some other immigrants.

Under current directions you must apply for extension before your current leave expires. If the extension application remains undecided by the time you become eligible for settlement, you may vary ( https://www.gov.uk/government/uploads/s ... e-v8_0.pdf) the extension application to settlement application.
