Extension to Ilr

Hi
I got my tier 1 ent visa on 13 Dec 2012. Then I got married and my wife came here in August 2014 and I have a son now as well. And I got my visa extension which I received on 16 Jan 2016

Now I have some question regarding my next visa process

Firstly, can you confirm that i am correct to say that the earliest i can apply for ILR is 15 Nov 2017?

Secondly, if for some reason I do not satisfy the character requirement, then instead of ILR i can apply for tier1 ent extension?

Thirdly, my wife has not been in UK for 5 years yet. So what form will she fill with me (without breaking continuous residence) at the time of my ILR as she can't apply for ILR yet?

Lastly, can I not apply anything for my son who is just 2 years old and apply for his british passport once I receive my ILR? A point to mention is that my son already holds an extension visa which is expiring in Jan 2018 with me

Yes as long as you satisfy all the conditions

She extends her PBS dependant visa

He does not need a visa to stay as long as he remains in the UK. He can be registered as BC when you are granted ILR.
If you want to travel with him outside the UK before he is registered, he needs to have PBS dependant visa to enter back just like your wife.

Once applying your ILR you can apply BC for him at the same time.If your application is approved he will be granted BC :I read this on this forum somewhere.

Not quite correct.

OP requires ILR and the BRP card, then he can apply to register the chilc as BC on form MN1 for the child which takes a few months. No 'in person BC' application process.

So does this mean that child has to apply dependant visa extension.
I m sure I read it on this forum where is mentioned for case worker to deal both application one after the other. Will look for it

A UK born child no. But it is different departments that deal with ILR and Citizenship. You cannot apply for them at the same time and you cannot apply for citizenship in person for a same day decision. You have 'read' wrong.

I m discussing postal application and UK born child.
If an Entrepreneur is applying ILR and have a UK born child will he apply his dependent extension or?

Not necessary if the child is UK born, however HO can and will likely ask about the child if the child already has a visa.

Kindly start your own topic with your questions instead of tagging onto another members thread, it is considered rude and is unfair the the OP of this topic.

Thanks for your reply but when you say I satisfy all conditions you mean my Tier 1 Ent conditions like employment, Investment etc

And for my wife when you say she apply PBS dependant you mean Tier 1 Enterprenuer Dependant?
