More than 180 days out of the country

Hi there, My wife will be eligible for ILR in December 2018 as she completes 5years in the country. We have blessed with a baby girl 3 months ago and my wife n baby going to India. Wife wants to stay in India for 9 months almost. I know rules say you can't be out of the country for more than 180 days in last 12 months. If she comes back and lives in the country for 12 months, can she then apply for ILR? Can you clarify, please? She is currently Tier-2 dependant. I just got my ILR last year. Thank you.

There is NO absence limit for PBS dependent visa holders.

She must return before her visa expires.

Are you sure? I thought they it is a standard requirement for every ILR applicant. Jai

No it does not. It ONLY applies to PBS main visa holders adn main Ancestry visa holders and NOT for dependents.
