Tier 2 Dependent for UK born Child (Premature) Until ILR

Hello,

Apologies if this is the wrong section for this question.

I am on Tier 2 General from last 4 years and 6 months. My wife is with me from last 2 years.

We had a baby boy an year ago October 2016, he was born premature and we haven't traveled to India since he was born as he has health problems which he is slowly recovering.

i am going for ILR in 5 months..

1. Does he(my son) need a visa to stay with us in UK until we go for ILR?

2. Can he wait until i go for ILR ? as once i got ILR he is eligible to apply for British Passport.

Not if he is not leaving the UK. If he leaves the UK, he will need a visa to reenter.

When you get ILR, he will be entitled to be registered as a British citizen and he can then apply for a British passport. He does not become a British citizen automatically.
