Dear CR001 & Zimba88 I am looking for your help and advice.
I applied for my TIER 1 Entrepreneur extension in Nov 2016, refused in Feb 17 because of Director's Loan Agreement was not fulfilling the requirement. Applied AR in Feb 17,which was refused in March 17. Applied new application with amended Director's Loan Agreement in march 17, interview conducted in Nov 17, have not got my result yet.
Now, I am completing my 10 years on 20 January 2018. I want to switch my application from TIER 1 to ILR.
1) Please advice me the process of switching the application
2) I am interested in Premium service. Advice me whether I can go for premium service by switching the application.
3) I have two dependent, my wife and 2 year old baby born here (I have sent their application with my extension as well).

You are an overstayer following the refusal of your AR.

So, you do not meet the condition of 10 year lawful stay as you are currently in the UK without a valid visa.

However, it appears that there are people who, in your similar situation, have been granted 10 year LR. It is not clear how UKVI accepted their applications.

That gives you good idea of the process for applying for the premium service, though he was not an overstayer like you.
