I came to UK in Feb 14 , I can apply for ILR in Jan 19 as per my understanding

I applied to for my extension but its still pending , If my application is not decided until jan 19 can I vary it to ILR and get refund of the fee for extension


Plus Can I claim 2 employees from my initial leave as it states during your last leave , and my initial would be my last as no extension

Yes in theory but that will be almost impossible. You should get a response soon regrading your extension

I know it will be impossible, but if he get rejection on Dec 2018 and he go for AR and no any response till jan 2019, can he still vary it?

If the AR is pending and section 3C is engaged, then there is no existing application to vary. But you can apply for a fresh ILR application at that point
