ILR for children born outside uk

Hello Gurus,
Please I need your help on my situation below.
I had my son in canada when I had ILR. Now I am naturalized.
I brought my son into the UK using his Canadian passport and he was allowed entry as a visitor for 6 month visa free.
He has been with me in the UK since the past 1 year although he has never overstayed his leave as I take him out and bring him back every six months.
My question is can I apply for his registration under section 3(1) without him having ILR? His father is also in the process of obtaining his British naturalization.
