Hi,

I am the family member of EEA National. I came in 2005 to UK on student Visa. I got married in 2008 with an EEA National and received EEA family Residence Card for 5 years. I applied for PR in 2014 after being 5 years on that Visa but I was refused the PR because my wife wasn't exercising the treaty rights.

I made the application in 2014 for Extended 5 Years EEA residence card which is still valid till 09/2020.

Now I am living in UK for 12 years and I want to apply for ILR via 10 years route but I have three CCJS

1st CCJ was in 2012
2nd CCJ was in 2016
3rd CCJ Feb 2018

I need advice for applying ILR please.

ILR long residence will also fail due to any period in your 10 years that your EU spouse was not a qualified person exercising treaty rights. You are required to submit substantial evidence for the WHOLE period you are claiming on the EEA RC route of your EU sponsor being qualified exercising treaty rights. If you do not have this documentation, ILR LR will be refused.
