SET LR for PBS Dependent.

Hi Experts.

Made an appointment for PEO application for my wife.

I got my ILR on long resident based and now I am a British.

My wife,
Enterd 2008 April 10 with 3 years Student dependent,
Switched to T1(G) on April 2011 as partner or dependen of T1(G)
Extended on April 2013, as T1 (G)
2014 I (Husbund) obtained ILR on long resident.
Than She switched FLR(M) on April 2016 ( No ILR) missed the chance because of April 2014 law changed.
I hope she is now (April 2018) eligible for ILR on long resident base.

1) Life in the UK obtained on April @2016. (No chance to use but obtained )
2) English B1 SELT obtained from Trinty College @ April 2016 (Used on FLR(M) )

Please advice me is she eligble to apply and if so what are the documents to be submitted and is she able to use english and life in the UK which obtained as above.

If she meets the requirements, including the absence limits and 10 years legal status, then yes she can apply.

The Set(LR) form states what is required.

English test must be on the current HO approved list.

LIUK does not expire.

1) should be okay as there is no expiry date on a "life in the UK test" pass and the test was administered by learndirect limited.

2) should be okay, if satisfies 2.2.
2.2 For the purposes of paragraph 2.1, an applicant demonstrates sufficient knowledge of the English language if:
...
or
(b) the applicant-
(i) has limited leave to enter or remain in the UK, and
(ii) that leave (or a grant of leave which preceded it provided any periods of leave since have been unbroken) was given on the basis that the applicant had an English language qualification at a minimum level of B1 on the Common European Framework of Reference for Languages.
(iii) at the date of application, the provider of that qualification continues to be approved by the Secretary of State as specified in Appendix O to these Rules.
or
(c) the on line verification system operated by an approved English language test provider, as specified in Appendix O to these Rules, confirms that the applicant has passed an English language test in speaking and listening, at a minimum level B1 of the Common European Framework of Reference for Languages, which is approved by the Secretary of State, as specified in Appendix O, and taken at a test centre approved by the Secretary of State as a Secure English Language Test Centre no more than two years before the date of application.

Thank you for the fast reply and thanks for advice, really apperciated,

Yes, her legal stay wasn't ever broken and she is been out of country only for 22 days in the 10 years time limit.
I was only worrying about the English certificate,

1) In the list of approved test.
2) SELT B1 from trinity college,
3) Been used and accepted on FLR(M) application.

Hope she is ok, Thanks again for the help and advice,

Hi CR001 and Vinny

Just got a doubt about the document submitting with the SET LR application for my wife,

As we got 3 children (all BC) my wife stoped working long ago but she is doing some voluntary working as a maths and English teacher at our kids’s School,
Do I have to attach any documents for the support of finance? (Not relevant for the application and even not requested anything on the application)

If yes is it ok to provide my financial documents (Bank statements, Pay slips, or self assessment documents) ?
Please advice me

Does Set(LR) ask for evidence of employment?? No it does not.

Follow the evidence the form asks for.

Hi Vinny and CR001

Just to update the status, my wife’s SET LR has been gone through and approved today at PEO at Sheffield, very straight forward and only taken 1 and 1/2 hours, just under 2 hours. Waiting for BRP on the post.

Thank you so much for your guys prompt advice and reply. Really appreciated.

Finally I hope now she can apply for naturalisation
And BP after wards, please comment and advice your valuable advice.

Yes, if she meets the spouse of BC 3 year requirements, she can apply for citizenship.
