Hi,
I am now eligible for ILR under Tier 1 General, and my wife is on Tier 1 dependent visa, she came to UK in April 2014. She needs an extension. We both have currrent visa valid until March 15, 2018.
I have to apply with SET (O) application but i'm not sure which application I need to use for her extension.
Can some one assist plase.

Tier 1 General Dependent visa extension. It will be a 3 year extension.

So 2 applications to put together and pay IHS fee for 3 years for her right
1 - SET (O) application
2 - Tier 1 dependant application
thank you.

Hi CR001,
We are planning to apply by post.

You will need to write a covering letter for your spouses' application as the forms are sent to two different departments.
If you have any tax issues while you were on Tier 1, expect delays for your ILR.
If your ILR fails, her PBS extension will also fail.

Thanks for the reply CR001,
if our appplications are considered until next March 2019, my wife will finish her 5 years in UK, can she vary her to ILR on PEO with my application still pending ?

No, she will only get ILR if you get ILR. A PBS Dependent cannot qualify or apply for ILR if the main PBS applicant does not get ILR first or at the same time.

ok, if we write a cover letter (with my details in it) will UKVI tag our two applications togehter ? they monitor my visa status and reject/approve it based on my application ? I mean we expect our status both at time either approval/refusal ?
Also, is there any specific format the cover letter should be ?

Yes write a covering letter with your dependents application.
Her application will be held until yours has been decided, only then will HO start processing hers.
Neither of you will be able to travel out of the UK while this is in process.
There is no template letter.

Ok thanks,
I'll just write a letter including my details and submit.
During this period, can we apply visiting visa for my parents to UK ?

Your parents will need to qualify for a visit visa and submit the required documents.
Kindly ask visitor visa questions in the General Immigration sub forum.

This might be an issue for you and you might very well suffer the same fate as many of the Tier 1 G forum members due to tax amendments and different amounts claimed to HO for extension and HMRC for tax due.

Hi Monty87,
Hope everthing goes well for you. All the best mate.
My case is 2010/11 tax issue. My Tier 1 treshold is £35000 but I have showed 39K to HO at the time of initial Tier 1 application and declared £32.5K to HMRC. I amended the 10/11 return to £39K in May 2016 and payed remaining tax aswell.
That is the only tax year issue i had. I am due to apply my ILR but im worried about the retrospective tax file returned.
Do you suggest anything on my case please ?

Hi,
My current visa is expiring on 18th March, can I submit ILR by post on 16th March ? Will UKVI collect next day delivery i.e. on 17th March (Saturday) ?
Please guide.
Thanks

The day you post is the date of your application as long as it is before the collection time that day (Royal Mail) rather than when UKVI sign for it or receive it.
Retain the postage proof.

Different for courier so choose wisely.
"The date of application for postal applications delivered by courier is the date it is
delivered to the Home Office"

Thanks Terri,
Unfortunately, I can only post on 16th and I can do next day delivery. If they can’t accept on 17th (Saturday), will they retain my work right ?

What visa route are you on? Depending on which route you are on, I would have thought you may have been able to apply/post 28 days before or within visa expiry?
Also as advised best to retain the receipt and go for a sign on delivery next day service.
Once the application is received and it has been received before expiry, then you will retain valid leave under section 3c and it should be treated as such, meaning your right to work should also be continued while a decision is pending.

Hi CMO,
Thanks for reply.
I’m applying ILR 5 year tier 1 route. I’d like to know if UKVI accepts application on Saturday as well as I’m posting on Friday. So that my application will receive to UKVI before my visa expiry.

As per earlier post, if you use Royal Mail it is the date of posting (before collection time) so shouldn't matter if they receive on Saturday or not, your application date will be Friday

In February you said your visas expire on 15th March, which is today.
