ILR application through Ancestry

Hi,

My husband and I are applying for ILR through Ancestry in a few weeks time. My husband is the main applicant and I have entered on his visa. My visa says "visa to acc spouse/cp". I have a few questions please?

1. Would I always apply as his dependent or can/should I apply separately? If I apply as his dependent does that mean he needs to prove he can support me? Or will they take into account that I am working and earning my own salary?
2. Question no. 6.13 of the SET(O) form mentions leave granted after 11 January 2018, what does that refer to? Because I have left the UK for family reasons since 11 January 2018.
3. It looks like 6.14 only refers to leave after 11 January, so do I not need to list all my dates that I left the UK in the last 5 years the same as my husband?
4. Question 7.14 asks about social ties to the country we were born in? What are they looking for here? I thought they would be more interested in ties to the UK?
5. In the documents section 12 they ask for proof of cohabitation for the whole 5 years we have been here. What is acceptable as "official letters"?

Any help would be very much appreciated.

Cheryl

You apply on one Set(O) form together. You simply need to prove that you can maintain youselves.
2. Question no. 6.13 of the SET(O) form mentions leave granted after 11 January 2018, what does that refer to? Because I have left the UK for family reasons since 11 January 2018.
It applies to the Points Based System visas not ancestry as far as I have read.
3. It looks like 6.14 only refers to leave after 11 January, so do I not need to list all my dates that I left the UK in the last 5 years the same as my husband?
No
4. Question 7.14 asks about social ties to the country we were born in? What are they looking for here? I thought they would be more interested in ties to the UK?
Not a trick question, simply answer truthfully.
5. In the documents section 12 they ask for proof of cohabitation for the whole 5 years we have been here. What is acceptable as "official letters"?

Tenancy agreements, council tax, utility bills, HMRC letters, DVLA etc etc

Feel free to ask any further questions you have or even just for a sanity check while getting docs together.

Hi again,

We are going to apply through post, it says it can take 6 months to get an answer. In your experience does it normally take that long?

And do we have to do anything in mean time? Because obviously we are going to staying over our visa date then if it takes that long, so essentially will be here illegally.

Also with cohabitation do we have to provide evidence for all 5 years that we have been here because we dont have for the first year and a half because we were renting a room from family.

Thank you.

Yes, it can take UP TO 6 months and sometimes longer.

No you wont' be 'illegal'. Provided you apply before your current visa expires, you are protected by Section 3C of the rules, which means your existing visa conditions continue until HO has made a decision.

Not sure actually. Would have to look at what the guidance and form says. Last 2 years should be sufficient though.

Hi,

Just a few more questions, we are going to apply in the next few days.

My husband gets paid every 4 weeks instead of every month. Under the Finances section (question 5.3) it asks what your monthly income is after tax, should we calculate what he gets paid per month even though this won't match his payslip then? Or should we just enter the 4 weekly amount that is on the payslip?

Question 10.12 asks if we had fingerprints done before? I cant remember if we had fingerprints done when we applied for ancestry visa originally. My husband seems to think we only had our fingerprints scanned. I have answered no here. Is it going to be a big problem if we had fingerprints taken and I have answered no. If we answer yes but cant remember the date or dont have details of the person who took them, what do we do?

And do we need to do anything for the biometric permit before we apply? Or will they notify us when we need to go in to do our biometrics?

For the payment of the application, we dont need to do anything for this? We have obviously filled out the payment details page with a vaild credit card. Will they take the payment when they receive the application?

Thank you for all the help.

Cheryl

State the 4 weekly, payslips will be evidence of this.

You would have enrolled biometrics at the visa application centre, so the answer is YES. You need to state the place it was done, i.e. VFS offices and the month/year is fine. You don't have to state the persons name who took them.
And do we need to do anything for the biometric permit before we apply? Or will they notify us when we need to go in to do our biometrics?
No. You will get a letter with a barcode (if applying by post) to go to Post Office (there is a £19.20 fee each) within 15 days to enroll your biometrics. If applying in person, it is part of the process on the day.
For the payment of the application, we dont need to do anything for this? We have obviously filled out the payment details page with a vaild credit card. Will they take the payment when they receive the application?
Nothing else to do, but make sure you inform your credit card company/bank that a large payment is coming off from HO. Payments are taken within 2 weeks of sending it by post.

Hiya,

Me again, hopefully this is the last.

I am little worried about the bank statements we have received from the bank.

Both my husband and I asked the bank the post us 3 months bank statements, which they did, but the ones they have sent us are black and white with just a colour cover letter.

In the cover letter it says "While duplicate statements are not laid out in the same way as the originals, rest assured the items on them are exactly the same".

Will they accept these or should we just go in and get stamped bank statements.
