Hello All,

I am planning to apply ILR on the basis of 10 years long residence. Please advise if I am eligible to apply for 10 years ILR and when (date) could I apply for my ILR?

Details are as below:

01.08.2008 – Entry clearance Student visa obtained valid until 31.01.2010
12.09.2008 – Arrival in the UK as a Student
22.01.2010 – Student Extension Visa Applied before expiry (31.01.2010)
02.02.2010 – Student Visa Application withdrawn due to medical Emergency
05.02.2010 – Withdrawal letter together with Passport received from HO
08.02.2010 – Returned to Home country
15.03.2010 – Re-applied for Student Visa from Home Country
29.03.2010 - Entry Clearance Student Visa Obtained and came to UK on 02.04.2010
15.09.2010 – T1 PSW Visa obtained (Switched from Student Visa)
30.05.2013 – T1 Entrepreneur Visa obtained (Switched from T1 PSW Visa which was applied on 10.09.2012)
20.06.2016 – T1 Entrepreneur Visa extension approved

Now, I have valid leave to remain as a T1 Entrepreneur until 20.06.2018 and I will be applying for my ILR under T1 Entrepreneur route. However, due to the current time scales if I wish to vary my application and apply for 10 years (Long residence) visa am I eligible to apply?

I do have a concern about the visa withdrawal on 02.02.2010 and I am unsure whether my 3C was protected due to this break?

You are not eligible for long residence as you do not have 10 years of continuous lawful residence. You left the UK without a valid visa and applied for entry clearance more than 28 days from the date of your visa withdrawal. This means your continuous period of stay is broken and you are only eligible for SET(LR) in 2020. You should apply for SET(O) under Tier 1E instead.
