It certainly is not available to just those refused asylum, as my wife originally came on a Spouse visa in 2009 (before the implementation of the appendix FM legislation) and although she could apply for ILR after 27 months, we needed more time due to financial issues at the time, we applied for an extension but was refused and was granted DLR, in which she has to complete 6 years of it to be eligible for an application of ILR.

DLR can be granted for any compelling reasons and is discretionary so by the secretary of the state or those acting in her behalf (immigration officers).

Just to be clear, this route is now closed since and from understanding 9 July 2012 and only transitional arrangements are in place to those granted under this route.

There have been many members that have successfully applied for ILR using PSC appointment on the form SET(O) after they were granted DLR from a failed asylum application.

Click this link

You will get a lot of information as well as commonly asked questions, please note there have been many more members since successful with their application since that post was made and most of them were granted DLR after a failed asylum application.
