SET(M) confused with 60 Month time period & 28 days rules

Hi Everyone,

Could someone advise me please?

I would like to apply for SET(M) based on 5 year rule but I am bit confused when is the earliest I am allowed to apply for the settlement?

please see below my timeline

My 1st spouse visa issued on 15/03/2013 and valid until 15/12/2015 (2 years and 9 months)
I have entered UK on 25/04/2013
Applied/Renewed the spouse visa during Dec 2015 and received bio metric card with visa valid until 30/07/2018 (2 years and 6 months)

Since my 1st visa issued on 15/03/2013 and I entered UK on 25/04/2013, I have lived in the UK for more than 60 months now (end of April 2018, I have completed the 60 months). if so, can I apply for the SET(M) now or should I wait until July 3rd to satisfy the 28 days rule?

They have mentioned that we should not apply for visa before 28 days from the expire date. I am confused. pls. help?

You could have applied within 28 days before 25th April already.

Thanks. Is that mean i can apply for settlement now and do not need to wait for July?

are you able to explain these two rules please? 60 months and 28 days

Yes.

You are eligible to apply for ILR 28 days before reaching 60 months residence, counted from the date you entered the UK.
