SET(LR) application while appeal pending, Please help..

Hi, My wife's appeal is pending and hearing date is in September. Now she will finish her 10 years in last week of June. Can she apply for ILR on the same day service? If she can than she needs to cancel or withdraw her appeal but as soon as she cancel her appeal she will loose her continuous leave(c). I heard that without the cancellation letter from court HO do not accept any application. So what will be best thing to do? Applying by post or going same day? When will be the safe for her to withdraw the appeal?
