ILR DUE IN STEPTEMBER 2018.

Hello everyone;
I came into the country in steptember 2008 as a student.I had serval visas for years not untill last year when i had no other visa to stwich into but luckly for me my daughter was 7 last year so i decided to apply gor the 7yrs route.It was refused this yr with a right of appeal.I ve put the appeal in and a date was gaven so fast :my hearing date is on july d 4th but i will be 10yrs in steptember the 13th .am so confussed as i do not no what to do.Any advice plssssss.as I am not if i ve any hope at d moment.pls all advice will be graetly appriciated.as anyone come across a situation like this before.thanks to you all.

It would be appreciated if an immigration history with dates be given In order to help you, as that Information to go by is very vague.

You do not mention whether the visas were applied with in time or out of time. You also don't mention why the last submitted application was refused.

hi everyone.
i have got an appeal on the 4th of july 2018.my 10 yrs resident is due on steptember the 13.my worrie re
1.if my appeal is refussed by the FTT,and i apply to the upper tribunal and the dont grant permissio,will my 3c be broken?

2.is there anything i can do if FTT refuses to grant permission to upper tribunal without breaking my 3c?

3.can i make my ilr in august?

pls kindly reply as i am in a serious mess right now.after comming this far. :cry: thanks alot.

thanks for your reply.most appriciated.but pls what do you think my chances are since you said i can apply in august.do u think i can buy enof time from july the 4th to august 13?cos i dont know how quick you get your decission from the judge and how long it takes to also get a decission from the upper tribunal saying yes or no?pls kindly asssist.thanks alot.its will be so sad if after my ilr is broken just because of few weeks.am really in a mess right now.thanks .

I have gone through these process few years ago and lower tribunal will take atleast 4 weeks to give the decision and after that you have little time to apply to upper tribunal to allow the appeal etc
It will take atleast 4 months to go through this process as waiting times are quite high at the moment .
You are safe don't worry

When did u apply to get appeal date in July 18 ?

hi sunny and thanks alot for ur reply.i applied october and my appeal date is on the 4th of july 2018.my ilr is due on the 13th of september.i was told that i can apply in august (15th) as you can apply 28days before.pls kindly explain clearly how the tribunal works pls.
1.how long does it take to get permission from FTT after hearing.

2.if your appeal is refused ,pls how long does it take to get permission from d FTT to UT?weather granted or not.

3.is it through that you will recive an acknowledgement first before the proper decission stating yes or no?
thanks alot one more time.my situation is really trearing me apart.

Hi
Iower tribunal takes up to 4 weeks to give decision ,if it’s denied ,
After that you have 2 or 14 days to request lower tribunal to allow your appeal to be heard at upper tribunal ,if they refuse permission (at lest 2 months )
You can directly apply to upper tribunal ,after that UT will send you hearing date and it can take up to 2to 6 months .if You fail at UT you request court of appel to hear your case and it takes at least 1 year to get reply ..


It’s a long process .
You are completely safe .
Just make sure you paid all ur taxes and your 3c was not broken previously

HELLO EVERYONE

I CAME TO THE UK IN SEPT 2018 AND LIKEWISE MY HUSBAND. WE HAD ALL OUR 4 KIDS IN THE UK. MY ILR IS DUE 13 SEPT. 2018 AND FLR (FP) APPEAL COMING UP 4TH JULY 2018. I APPLIED WITH MY ENTIRE FAMILY.MY HUSBAND, IST CHILD WILL BE 9YRS AND 1 DAY OLD ON APPEAL DATE, 2ND CHILD WILL BE 7YRS AND 6 MONTHS, THIRD CHILD WILL BE 6YRS AND 1 MONTH AND 4TH CHILD WILL BE 1 YR AND 8 MONTHS. AM PREGNANT AND EXPECTING MY 5TH CHILD SAY 9TH -11TH SEPT 2018. WE LIVE IN LONDON WHERE WE RENT OUR HOME BUT MY HUSBAND HAS TWO HOUSES IN THE UK (NORTH OF ENGLAND) WITH NO MORTGAGE ON ANY AS HE BOUGHT OUTRIGHT; THOUGH NOT THE COSTLY TYPES WE HAVE IN LONDON AND ARE RENTED OUT AT THE MOMENT. MY HUSBAND IS SELF-EMPLOYED (A SUPERVISOR IN THE CONSTRUCTION INDUSTRY) AND HAS A REGISTERED LIMITED COMPANY IN THE UK SINCE 2016 AND PAYS HIS TAXES REGULARLY. MY HUSBAND HAS A MASTERS DEGREE IN OIL AND GAS AND I HAVE A MASTERS DEGREE IN BUSINESS INFORMATION TECHNOLOGY; BOTH FROM REPUTABLE UK UNIVERSITIES IN SCOTLAND AND ENGLAND RESPECTIVELY. THIS IS OUR 10 YEAR IN THE UK.

I HAD TIER 2 VISA UNTIL SEPT 2019 BUT LEAVE WAS CURTAILED UNTIL OCT. 24TH 2016, I APPLIED FOR EEA RESIDENCE CARD IN DEC. 2015 BUT WAS REFUSED 20TH MARCH 2016, WE APPLIED AGAIN 11TH JULY 2016 AND WAS REFUSED 21ST OCT 2016 WITH RIGHT OF APPEAL. AS I STILL HAD LEAVE UNTIL 24TH OCT 2016, WE PUT IN FLR(FP) 21ST OCT 2106 AND WAS REFUSED IN NOV. 2017 WITH APPEAL RIGHT AND APPEAL COMING UP 4TH JULY 2018.

MY QUESTIONS ARE:

1. IS MY CONTINUOUS RESIDENCE BROKEN IN ANY WAY AS I GOT REFUSED TWICE (EEA APPLICATION) BUT STILL HAD A RUNNING VISA AND APPLIED FOR FLR FP BEFORE THE VISA RAN OUT?

2. WHAT ARE THE CHANCES IN PERCENTAGE IF YOU LIKE OF OUR APPEAL BEING ALLOWED?

3. I WILL BE 10 YRS 3 WEEKS FROM APPEAL DATE; WILL THIS HAVE ANY POSITIVE IMPACT ON THE DECISION?

4. AND MY FIRST CHILD WILL 10 NEXT JULY AND BE ENTITLED TO BRITISH CITIZENSHIP REGISTRATION; IS THIS A PLUS TO MY APPEAL OR NOT?

5. WILL HAVING 2 QUALIFYING CHILDREN MAKES MY CASE WEIGHTY IN TERMS OF WINNING THE APPEAL?

6. AS I HAVE PREGNANCY ISSUES WHICH MY GP CAN CONFIRM BASED ON MY PAST RECORDS, IS IT ADVISABLE FOR ME TO ADJOIN AND APPLY FOR MY ILR OR DO YOU THINK I SHOULD GO AHEAD WITH THE CASE COME 4TH JULY?

7. IF CASE IS ADJOIN LUCKILY TILL AFTER SEPT 14 2018, CAN I WITHDRAW APPEAL AND APPLY FOR ILR AS AM DUE SEPT. 13TH 2018 AND WHAT HAPPENS TO MY 3C AND DEPENDANTS.?

8. ALSO IF I DECIDE TO GO AHEAD ON JULY 4TH, WHAT IS THE POSSIBILITY THAT IF APPEAL IS NOT ALLOWED AND I APPEAL TO FTT AND MAY AGAIN TO UTT THAT IT WILL DRAG TILL SEPT 14TH 2018 WHEN AM DUE FOR ILR?

9. AS AM APPEALING TO FTT OR UTT, DO I STILL HAVE 3C? WHEN DOES MY 3C BREAK IN MY SITUATION?

10. FINALLY IF APPEAL IS ALLOWED, WILL I ENROLL ANOTHER BIOMETRICS?

pls kindly help, I will be 10yrs in September 13 but have a hearing in July. can I withdraw my appeal in August 28 days before 10yrs or wait till September.secondly I am so worried if my 3c will b broken along the line as I really don't know if my appeal will b granted or eshausted before then.the application made was flr (fp) based on my daughter who was 7 but now 9 plus.thanks alot as I await ur swift reply.

Hello everyone...

I got a letter from my GP and asked the tribunal for adjournment. They responded last week accepting my request but yet to give me a date.

Initial date was meant to be 4.7.18. My 10 yrs long residence is due 13.9.18 but no new hearing date yet.

I have a few questions that need answers for me to proceed.

1. If I get a date beyond 13.9.18 can I apply for ILR
2. Also is it okay for my solicitor to write HO to ask for reconsideration based on the fact that I will qualify for ilr.
3. Or should I wait on the hearing day and raise further grounds for consideration.
4. Is there any possibility of HO withdrawing due to my ILR.
5. Will HO grant us 2.5 yrs each or will they ask me to withdraw and apply for ilr and if that is the case what happens to my dependant if I apply for ilr.
