T1 Ent. to ILR Job Creation

HI.
Long time lurker. I have a question regarding the timeline with applying for ILR

My info as below

Tier 1 Permit Issued – 01/07/2013

Extention application sent - 13/06/2016

Tier 1 Extension Permit issued – 31/07/2017
Valid Until - 31/07/2019

I currently have 1 Employee that's been working full time since 21/11/2014.

My question is: am I able to apply now as my 5 years since I've been under this visa has come. Or does the job creation clock start when the extension permit starts, thus wasting more than 1 year?

Hi

You need 24 months fulltime employment in your recent grant of leave i.e extension(Tier 1 Ent).

You are eligible for ILR based on this route from niw but your Job creation criteria is not met according to the info stated. You are covered by Transitional arrangements but from April 2019 onwards you will need 2 separate jobs of 12 months each to fulfill the requirements.

Yes, I was planning on using the 24months of my 1 employee.

if the 24-month clock starts from the extension permit period, meaning I've lost a whole year waiting for the extension to be granted?

For me to apply before April 2019, I will have to employ someone else for 6 months and apply in January (1st employee would be 18months by then).

It seems a bit unfair to write off a full year of employment for 1 person because they decided not to be swift with my extension application.

Or is there something else I'm missing

The rules are specific and required to be met for ILR application via this route.
