ILR application while on notice to switch tier 2 employer

Hi
I’m currently on notice with my current employer while switching to a new employer from mid September onwards. I’ve already obtained a new Tier 2 BRP for the new employer.
I will be due to apply for an ILr after completing a five year period by end of August.
I want to confirm if I can apply while on notice, using the confirmation of employment from the new employer or do I need to wait till I’ve started in my new role?

I think you have to get a letter from your new employer that you will be required from your role in the foreseeable future. However, as you even not start yet so if obtain this letter from your new employer it will be odd.
And one of the document you need to submit is the latest payslip, it is better from your new employer rather than your old one. Obviously odd if you can only provide old employer payslip but a letter from new employer that you are required. And payslip also the proof the you earn more than 35500 (if applicable).
So if I am you, I would wait until I have a full month payslip from the new employer.

It might be better to do 2- 3 months with your new employer before applying. And don't forget to get the letter of absence from your previous employer before you complete your notice period
