Sent back to safe country once refugee visa is up?

Hello

I am posting a question on behalf of my Kurdish friend. He has 5 years indefinite leave to remain W with 3 years remaining. He is wondering what happens after the 3 years is up? Will he be sent back to Kurdistan as it is considered safe?

Or will he get automatic right to apply for settlement?

By current immigration rule and guidance, it won't happen. After 5 years satisfied, he can apply ILR, even his country is safe to return. But if fails, usually discretionary leave would still be given. But if not, then he may really be deported if the UK consider the country is safe to return.

He has been cautioned by the police as a result of domestic abuse towards his now ex girlfriend.

Will this impact his application?
