Can My spouse make a pending application?

Hi all,

Thanks for the good work, it is greatly appreciated,

Background:
I have a pending ILR application (SET (O)) which is yet to be granted. My current visa is a Tier 4 DES visa and my wife is on a Tier 4 DES dependent visa. Both our current visas expire in a few weeks.

Query:
1) As my ILR is in progress, Can my spouse apply using FLR(M) and have that application pending an outcome from my ILR application?. I have heard about this but I don;t know if it is legal, if it is acceptable.

2)If Yes, are there any grounds for refusal based for my wife's early application before my application was sorted out?
