Ent extenstion to FLR-FP to ILR-LR

Hi everyone,
I m new to this forum and I need urgent help regarding my case. My and my family scenerio is explained below:
I applied fof T1 Entrepreneur extension, given biometrics and my solicitor advised me that my success rate is very low because I was unable to complete one job requirement due to a worker left in emergency for one months and leaving me short of time. So i was able to complete one job but not 2nd.
Solicitor advised to go for FLR-FP and i applied with family together, fees deducted, received t1 extensio fees back (short £600) and given biometric as well.
And now received a refusal letter for FLR-FP on 23rd of this month with date of 18 august with right of appeal.
Now my question is i have spent 9 yrs and 11 month. Simply speaking 28 days remaining in 10 yrs.. but i have refusal issued 6 days before.
Can i apply for 10 yrs long residency?
Do i still have continuity maintain or broken (but i still have 10 working days to file appeal for FLR-FP) to apply ILR-LR?
