Dear Gurus:

Thank you all for the valuable information in this forum!

I am considering to apply ILR under Tier 1(E) on 1 March 2019, please refer to my visa timeline:

My initial visa granted 01 March 2014
landed UK on 23 March 2014
Extension given 30 May 2018
Extension expiry 30 May 2020

Could any Guru answer my questions below?

1. According to Tier 1 (E) Policy Guidance P34, it is stated that where that leave was granted less than 12 months ago, for at least the 12months immediately before the date of your current application.

I intend to apply ILR on 1 March 2019, buy less than 1 year after the grant of extension visa. Per my understanding of the guidance, I should be able to apply on 1 March 2019, even it is less than 1 year of my previous grant of extension, which on 30 May 2018. Could you please help confirm if my above understanding is correct or not?

2. the employment counting period could be start from 01 March 2018 to 28 Feb 2019 as this is the 12m immediately before the date of ILR application. Could you please help confirm if my understanding is correct or not?

3. As my application for ILR will be before 6 April 2019 and my initial grant is before 6 April 2014, so I am allowed to use the transitional arrangement for job creation. Could you please help confirm if my understanding is correct or not?

4. How could I combine my job creation? There are three position in my company as below:

Position I: staff a_worked for 2m and 2 weeks (32hours/week); then staff _ worked another 3m and 3 weeks(30 hours/week), shall i assume the total countable job creation for this position is 6 months 1 week? Could you please help could I calculation their workings weeks towards 104weeks for the period from 1 March 2018 to 28 Feb 2019?

Very much appreciated for your replies to my above questions.

You can apply for ILR within 28 days of completing your 5 years.
Yes you can use the employment created within the immediate 12 months as your last leave was granted less than 12 months from the ILR date.
Transitional arrangements will apply to you.
Count the number full time weeks (30+ hours), there should be at least 104 weeks to be eligible

@Zimba, according to guidance, it is stated that you can apply for settlement up to 28days before you will reach the end of the qualifying period.

When was the start date of my qualifying period, 1 March 2014 visa given date or 23 March 2014 landing date?

Thank you for your help again!

warm regards,

As has been stated 100s of times on the forum, it is counted from visa START date for PBS migrants.

Dear Gurus:

After submitted all of the documents for the tier 1 ILR application under the new system last Saturday in the Sopra center, I found one document not uploaded. Could any gurus suggest to where can I send/email the document to UKVI, thank you for your help.
