ILR & Tier 2 Dependent Renewal

Hi,

I am a current Tier 2 general visa holder who is due to apply for ILR in the month of October through the 5 year route. My current Tier 2 visa expires in the month of December 2018.

My wife is currently on a Tier 2 dependent visa and her visa expires in the month of December as well. As I understand it, she cannot apply for ILR along with me as she has not completed 5 years of continuous stay in the UK.

Based on the above, I hope someone can answer a couple of questions for me because I am a bit unclear having read through all the documentation:

1. Does my wife have to apply as an ILR dependent or is it sufficient if she renews her current Tier 2 dependent visa ?

2. If she can apply for a Tier 2 renewal, at what point can she do this ? Will she have to wait until I get confirmation on my ILR application or can she do this in advance ?

1. Extend current visa.

2. After you get ILR ideally. If you apply for ILR by post, she must apply to extend her visa before her current visa expires. You have to maintain £630 for 90 days, don't forget.

You don't state when her visa was first issued and when she came to the UK, usually helpful to post this :idea:

Thanks a lot @CR001. My wife's Tier 2 dependent visa was issued in Nov 2013 and she came to the UK first in Jan 2014 on the same visa.

Regarding point 2, can I ask you a couple of questions please -

- Do I have to maintain this amount in my account or can my wife maintain this in hers?

- Can we maintain the £630 (for 90 days) in a savings account or does this have to be a current account ?

Either of your current or savings accounts.
