Hi All,
Request you to please advice me as i am planning to apply my ILR next month. I am on tier 2 general visa will be completing my 5years next month.
VISA issue date -10/nov/2013
Entered UK - DEC/2013

My previous employer did not pay me a salary for an initial 6 months and company got closed.so i switched to another tier 2 sponsor on 1/jun/2014
can you please help me with these question
1. As my previous employer has not pay me any salary for the initial 6 months. Will the caseworker check that tax and NI were not paid for initial 6 months. Will this be a problem for my ILR approval.

2. As i entered UK on Dec 2013, There will be no tax paid or P60 for financial Year 2013. I am worried this will be flagged when i go for my ILR. Is it a right assumption?

3. As i will be completing my 5years next month. Is it better if I delay my ILR application by 6 months and go for ILR on April 2018.. instead of Next month so that i will have 5 P60 with me and case worker will only look for my last 5 years where all the taxes will be shown as paid. Is my assumtion correct?

4. I am not sure if my employer has paid tax for my initial 6 months or not. Is there any way to find out if taxes are paid for an initial 6 months with HRMC?

Appreciate your help on this

1. You post at 1am in the morning when most of us are sleeping. Please be a bit patient.

2. There is no requirement to submit P60. However, you should be aware that a member was recently refused for the same scenario of not being paid for a few months initially on tier 2.

The first link I provided explains a user being refused for similar circumstances.

If you were not paid during the 6 months, then there was no tax paid either. Was it an umbrella company? Did you have to find your own contracts or similar?? Why were you not paid for 6 months??

its was not a umbrella company.. company was not doing well and eventually it was closed . thts the reason i was not paid .

can you please comment on 3 point of my question. is it safe to wait till next year so that i will have 5 p60 by that time . and it will be safe to go for ILR .
