Evening
My wife is coming to the end of her 2nd spousal visa and is applying for ILR. I ( husband ) am British. On the online application it is asking whether she is applying as a Tier 1 or Tier 2 dependent. Anyone know which it is . Tks , Simon

Neither. She should be applying for SET(M) as the spouse of a British citizen, not as a dependent of someone who is on a PBS (work) visa.

ILR same day service

Morning
My wife is applying for ILR on 4th Jan and we are worried by the speed of issuance of it ( due to Brexit ) so paying the £600 for same day service seems worthwhile to us. Our questions are:
1. How long in reality do you have to wait to get a decision on the normal route
2. We are applying on line so I take it we can't book an appointment till after we have paid for the ILR on 2nd Jan ?
3. Do we need to make a paper application too for the same day service?
4. How easy is it to get a date to get the appointment ? Will it likely to be months after we put the online application in?
Tks
Simon

Brexit affects EU citizens (non British) and their family NOT applications made to HO under the UK immigration rules, so not sure why you believe Brexit has an effect on your spouse ILR.
1. Not sure what you mean by 'normal route'. Presumably you mean postal. It takes on average 4 to 8 weeks at present.
2. Correct. You can book appointments up to 42 days in advance. If you try to find an appointment on 2nd January for the 4th January, you will unlikely find none available.
3. No, not if you use the online form.
4. With difficulty as some members have reported. You can only book appointments up to 42 days in advance. It is too early for January now.

Thanks for that .
I thought the process would be slower sue to the increased workload for the Home Office at present .
It says you can't make an application more than 28 days before the end of the Spousal Visa. How can you book an appointment 42 days prior to expiry of the Visa then? I have already completed the ILR application in readiness for Jan 4th but havent completed the payment section yet as we are away from 29th Nov till Jan 1st 2019. Are intention was to send the online application once we returned on 2nd Jan 2019 and the follow up documents the following week ( think you have 15 days to send them ) but if we decided for a same day service I take it we would put the online application in early december , Pay the extra for same day service , try and get a date in second half on January and bring all the documents to that ?
However 4-8 weeks wait is not too bad . i thought people were waiting 6 months plus for a decision!
Best
Simon

For ILR in person premium service, the date of your appointment is the application date and not the date you submit online.
Appointments are available to book up to 42 days in advance but you can only apply and have your actual in person appointment no sooner than within 28 days before reaching the 5 year residence mark, counted from date you entered the UK. So you can book in advance as appointments get booked quickly.
If you apply by post, the date you submit online is the application date.
It is too early to book an appointment now or submit online.

Hi CR001,
Did I understand you correctly, is the current processing time for ILR 4-8 weeks? Does this include ILR long residence 10 year? I've been trying unsuccessfully to book a premium appointment so if that is more or less the waiting time then I might consider postal instead.
Many thanks

Morning
I am applying for my wife's ILR after spousal visa route - that expires on 4th jan 2019. We wish to use the same day service but am confused by when you can make a reservation for a date for the service . We are out of the country from 6th dec till 1st jan 2019 . Shall we submit our ILR application while we are away ( we have it ready now but will not be able to get payslips through till end of Dec 2018 ) - you can submit 28 days prior ? And when we do that we can book a date in January for the same day service bringing all the documents with us?
Thanks
Simon
