Dear Moderators,

I need guidance about rules of absence from UK which may affect my settlement application.

I would like to bring to your notice that, I am residing in the UK on a spouse visa ( Spouse of a British Citizen). To give you a bit about my background, in April 2015 I got married to a British Citizen and we applied for my visa in May 2015, which was granted in the same month. I arrived in UK on 10 June 2015. Following that in February 2018, I have successfully extended my spouse visa until August 2020.

A bit about my husband's background, my husband was a Indian Citizen and he acquired settlement (Indefinite leave to remain) in UK and later on British citizenship based on a 5 year work permit.

I would like to enquire about rules of absence from UK which may have an impact on my settlement (Indefinite leave to remain) application. Could you please confirm the following:

a) Are there any rules about maximum number of days, I can remain outside of UK in any given year.

b) Are there any rules about maximum number of days, I can remain outside of UK in the last 5 years.

c) Clarification of what are the actual rules for absence from UK.

I look forward to hearing back from you.

Regards,
Dil

There is NO absence limit for people on a spouse visa.
