Can I work if applied for postal ILR

Hello All members,

I have applied for ILR (Set LR) on 10 years route by post. Money has been deducted from my account. I am getting many job offers but getting stuck with the visa status.

Can anyone please help me whether i am eligible to work while my application is pending.

You could work but until you have ILR, you will be unable to prove your right to work to a new employer.

As you have varied to set LR from flr FP, what is your UK immigration history and the most recent visa you had?

Came in this country as a student then poststudy work then tier 2 sponsorship for 6 years. Then i applied for FLR FP, and now i have varied my application to ILR on 10 years ROUTE. Currently I am not working.

can you pls tell whats your timeline of applying by post? After how long, did homeoffice deduct fee?

Hello Umair,

Your question bit irrelevant to my question however below is the timeline. Still waiting for biometrics.

Applied on 17/08/18.
Reached on 20/08/18.
Acknowledgement on 05/09/18.
Fees Deducted on 08/10/18.

Hello CR001,

In my case still i wont be able to prove my right to work to a new employer? What can i do next? as it really hard to bear expenses and my saving is almost all vanished.

Please help!!!!

Can I ask why you did not apply for ILR based on 5 years tier 2?

What date did you apply for FLR FP?

When did you leave your tier 2 sponsor and why?

Do you have dependents in the UK with you and if yes, how long have they been here?

35k Salary requirement was not fulfilled amd they were not going to give.

No dependants in uk.

Tier 2 expired in end of Feb and flr fp applied on just before expiry date.

What basis/reason did you use for aFlr FP or did you use it only to "buy time"?

What is your full UK immigration history and visas held?

In feb 2010 i got post study work permit. In feb 2012 i have got sponsorship tier2 general for 3 years + 1 extension and then 2 years extension.
Total 9 and half years never ever over stayed always payed all taxes as a part of salary.

Why did you leave your tier 2 sponsor if you submit FLR(FP) before your tier 2 visa expired?

I am not sure about that as it was dealt by my solicitor.
My son is born in uk and he was only 9 months old when i applied for flr fp and this was one of the reasons.

If you were still working for your Tier 2 sponsor and submitted an FLR(FP) application before tier 2 expiry, your Tier 2 Visa conditions would have continue under Section 3C of the immigration rules and you would have been able to continue working until such time as HO made a decision on your application.

However if you left your tier 2 sponsors employment, then you would have struggle to prove your right to work and any new employers are within their right to NOT employ you.

You seem to have used FLR(FP) to purely buy time. UK born child that is only 9 months old gives no entitlement to the parents, child could easily adapt living in the home country.

As you feel my questions might not be relevant, I will leave others to offer any further advice.

Thank you very much cr001 for such prompt reply. There is no point in taking matters on ego on public forum. I am realy sorry and with all due respect still i cant find the relevance behind the reason and work rights.
What should be my next steps.

It is not 'ego', it is asking relevant questions in order to answer you appropriately. If you choose not to answer or provide information, don't expect useful advice for free on the forum and then perhaps engage a solicitor and pay for the advice you want to hear.

You clearly are not reading my replies (section 3C if you stayed with tier 2 sponsor) or answer my question of if you have left your tier 2 sponsor employer, so I won't comment or ask any further questions.

I read all your answers very clearly. I got the point as i am not with the last sponsored employer i wont be able to prove my right to work to new employer.

My question was what is the next step? Can i do something to get right to work from a new employer?
