Reset of 5 years for ILR for dependant

Dear all

I came to UK on 1 March 2013 on a 3 years visa as a PBS dependant. My Spouse got his ILR(indefinite leave to remain) in June 2015 while I was his PBS depandent.

In July 2016, I have extended my visa using FLR(M) form in order to compete 5 years prior to applying for ILR.

Can anyone please confirm if my 5 years have been reset as I have switched from PBS depedant to FLR(M) of the same spouse?

I have been reading on the immigration rules and there is rule 319E. Requirements for indefinite leave to remain which I think is relevant in my case. Does anyone have had a similar situation? what form should I use?

Yes, your immigration clock was re-set to zero when you switched to FLR(M), putting you on a new 5 year path to ILR. All legal residence however will qualify for 10 years long residence.

Was your husband granted ILR under long residence or under the 5 year PBS category? If it was the latter you could have extended your PBS Dependent visa, although this doesn't change your situation now.

You will qualify for ILR in 2021.
