Hi,
Here is my immigration history:
Workpermit - Feb 2007
HSMP- Mar 2008 - Mar 2010
Tier1 - Jan 2010 - Mar 2013
ILR - May 2012
Passport - Feb 2014
Here is my employment history:
self employment - May 2013 to till date
Here is my wife and daughters (6 year old) immigration history:
Previous Visa: (for wife and daughter)
---------------
Visa Start: 12/11/2013
Visa End: 12/08/2016
Entry: 22/01/2014
Current Visa: (FLR (M))
------------------
Permit start date: 10/08/2016
Permit end date: 12/02/2019
I am looking to apply for settlement visa after FLR (M). So hoping I need to go with this route:
https://www.gov.uk/settle-in-the-uk/y/y ... ier-5-visa
https://visas-immigration.service.gov.uk/product/set-o
Could you please help to clarify on below questions?
- Is the above route is the right one?
- She cleared IELTS in below instances. Are these acceptable as english qualification in any way?
=> Cleared IETLS in 2013 in India when we applied for initial visa (when i was in ILR) which was accepted by HO
=> She took IELTS Acacdemic 11 Feb 2017 for other purposes
- If the both of the above not accepted what is the quick and easy test route please?
- Is there any absences limit?
- Is my daughter eligible for British passport or need to follow her mother's route?
- Can you please help with master documents checklist?
Many thanks,
Vinodh.

1. She needs English B1 for ILR. So the test at an HO approved test centre, quickest way.
2. They apply on form Set M if they have 5 years on spouse settlement visa and not on form Set O as they don't hold a PBS dependent visa.
3. There is no absence limit.
4. Much the same evidence, updated, as was provided for flrm extension.

Hi,
Many thanks for the quick response.
Just around english requirement:
When I was digging through ielts website, I came across this link (image attached too).
https://www.ielts.org/-/media/pdfs/ielt ... ashx?la=en
I was just trying to check if the below accepted using this route?
=> She took IELTS Acacdemic 11 Feb 2017 for other purposes
Can you please help to clarify?
Thanks,
Vinodh.

My understanding is that the academic test is required for study purposes and not ILR.
At the risk of losing £3k ILR fee, why not simply pay the £150 for B1 English if a UK degree is not held.

Hi,
Thanks for the quick response again. Totally get your point but was thinking because I could see only one date available before Feb 12 (which is visa expiry) and having trouble in booking the last available one which is Jan12 with that horrible website

. Just checking in worst case scenario, if we can't get a date or clear before Feb 12, is there any buffer time post expiry date please?
Thanks,
Vinodh.

Trinity has availability apparently. Why are you only looking at one website when the HO guidance and list suggest two?
You must apply for ILR before visa expiry, there is no 'buffer'.

Hi,
Many thanks for the quick response again. I admit I really confused with this spreadhsheet on interpreting.
https://assets.publishing.service.gov.u ... ebsite.pdf
To help me find the right one, can you please confirm if below is accepted for this application?
https://www.trinitycollege.com/site/?id=3220
Thanks again.

Hi,
Just a quick query. I read I could apply for visa before 28 days before the expiry which comes out as 14th Jan 2019 (as the expiry is 12th Feb 2019). But want to check, is that means I could book an appointment also only on or after 14th Jan?
Many thanks,
Vinodh.

They cna apply no sooner than withing 28 days before the 5th anniversary of the date they entered the UK (22 January) OR before their current visas expired.
Do not apply online too soon or book appointment before they are eligible to apply.

Hi,
Thanks for your quick response as always. Just want to clarify, so 25/12/2018 is when the window starts for me to apply for them in this case?
Agree on your point of not applying too soon before they are eligible.
Thanks,
Vinodh.

Hi,
I am in the process of filling out online application form and come across Finance section. Now I have been doing contracting (in IT) since Apr, 2013. I am the director of my limited company and my wife is an employee of the my company since Apr, 2014 and I am running payroll and dividends for her since then. So can you please help out on below questions?
Which types of income will you rely on to meet the financial requirement? - Self employment or employment?
Add self-employment income for: - Can I just choose my wife alone because the total income from self employment is above 40k for her?
Business or company email address - I don't have company domain email so shall i put my personal email account there please?
Please provide the end date of the last financial year, or if a director of a specified limited company, then provide the end date of the company's last financial year. - Should I choose the year end date from tax return (generally 5 Apr) or company accounts please? Also I haven't filed for the year ending 5 Apr 2018 yet, so shall I choose 2017?
Evidence of ongoing employment as a director of the company or of ongoing dividend income from the company at the date of application - So shall i provide divident vouchers for this?
Do you have any other reasons for wanting to stay in the UK? - Will this be considered if i put staying as a family?
Will I be able to edit application details if I proceed after "5. Declaration" page?
Many thanks in advance.
