Entrepreneur Tier 1 extension to ILR need Help

Hi

I got my Tier 1 Entrepreneur (50K) visa on 19th March 2014 from PSW. My wife joined me after 6 months in September 2014. My Son was born in UK in Feb 2016. I applied for our extension in March 2017 which was approved on 2 May 2017. Now I need help for my ILR application.

My Employees started working from Jan 2016 and continued till July 2018. So I fulfil the requirement of one year emplyoment (June 2017 to July 2018) for ILR.

Im thinking to submit these documents with my visa application. (Please let me know if I need to add any other documents)

1) Certificate of incorporation
2) Current appointment Report
3) Confirmation Statement
4) Business Bank Statement
5) CT41G
6) CT600
7) Company Accounts 5 Years
8) Employment Creation
i) Salary Slips
ii) Full Payment Submission/RTI
iii) P 11
iv) Copies of Passports
9) Life in UK Certificate
10) M.sc. Degree form UK University for English Language

I need your help to clear these points:


1) Can I apply for my ILR 28 days earlier from 19th March 2019? Or do I need to wait till April to apply for my visa?
(Considering the fact that my initial visa was approved on 19th March 2014 & extension on 2 May 2017)

2) What should be the application for my wife as her 5 years are completing in September 2019?
(She has visa till 2 May 2019)

3) What will be the application for my son? (He has visa till 2 May 2019)

4) I believe there is no such requiremnt for 90 days bank statement for maintenence for ILR application?
5) I believe there is no such requirement for NHS fee for ILR application?

Im really grateful if you help me out in this situation.

rest all docs seem ok

(Considering the fact that my initial visa was approved on 19th March 2014 & extension on 2 May 2017) yes you can apply 28 days before the 5th anniversary of your initial visa date

2) What should be the application for my wife as her 5 years are completing in September 2019?
(She has visa till 2 May 2019)
they will have to apply as PBS dependent route till they qualify for ILR.

3) What will be the application for my son? (He has visa till 2 May 2019)
same. Once you get ILR you can apply for British Citizenship for son but visa is valid till May 2019 so I think you would have to continue as PBS dependent first as there is no other option. Wait for someone else to confirm this

4) I believe there is no such requiremnt for 90 days bank statement for maintenence for ILR application? correct
5) I believe there is no such requirement for NHS fee for ILR application? correct

Im really grateful if you help me out in this situation.

April? Within 28 days of 5th anniversary. 19 minus 28. And you don’t have any absences to worry abt?

PBS dependant extension before current visa expires

Register as British citizen as soon as you get ILR. Likely if you apply by late feb.

I just thought so as the sons dependent visa is expiring in May.
UK born children have an entitlement to register (can't be refused) and don't need a valid visa to apply provided the child is under 10 years of age when good character requirement kicks in.

HO will likely write to op though asking about the child's application or visa.

That means children also do become overstayer but this will not impact their BC application.

Just wanted to point out to OP. Did your wife got her visa same as yours in March 2014 and then joined you/entered UK in Sep 2014? If she got her initial visa in March 2014 she will complete her 5 years in March 2019 as per the new rule?

I just got to know the visa issue date will be counted for 5 year continous residency.

I just wanted to point it out as OP might also think its the UK entry date (wifes case) as rule has been changed in Jan 2018.

Please correct me CR001 if I am wrong.

Once your ILR was approved - Register your son as British

As your son was Born in UK he doesn't need to apply for his extension.

Only you need to apply for extension if you want to travel with out registering him as British.

All other questions are addressed by other members

When my first tier1 application was approved, my wife was in my home country. I’d applied her visa in July 2014 which was approved on 14-08-2014. She came in UK on 21-09-2014 to be exact.

The other thing I want to make sure about the bank statement of 90 days. I know for dependents One has to maintain £630 for each dependent. The maintenance should be in my account or it should be in my wife’s account. (Considering the fact that We are applying separately)

Maintenance for the PBS dependant visa can be held in the account of either of you.

Thank you very much for you reply, I've read the policy guidance about dependent visa and I'm bit confused about it, it says

"Each dependant must have a certain amount of money (which is £630 for my case) available to them - this is in addition to the £945 you must have to support yourself"

It means I've to keep £945+£630 for each dependent??

It doesn't matter if I've applied for ILR before my wife's dependent visa?
(As you know ILR application doesn't require maintenance)

Please help me about it

I think u need Maintenance only for ur wife.Alas i did not know that kids cant be considered as over stayers; i applied for my 3 kids at extension time and paid their visa fee and health surcharge which went wasted.

Could anyone please let know about the Business Bank Statement requirement? I mean do i need to send just one month bank statement, three month, one year or it is any other requirement? policy guidance doesn't explicitly say about the requirement of months!

1 month business bank statement OR bank letter either of them will do

"an extra £610 if you use the super priority service"

Any one know about this service?
Can I apply through this service?

That gov website is midleading and not properly updated. You only have standard service for Tier 1 main applicant. Given, if the main applicant applies alone and is approved, and the dependents apply later on (given they have valid leave to remain), they can use super priority for extra £610.

I think there is a confusion here. If your children are not born in UK and they have visa as your dependent children and you are the only one applying for ILR, and there visa will expire soon, you might have to apply for their extension

No you don’t need to apply for his extension. Just register him after your ILR
