Hello

I need ILR advice for my husband. He has been living in uk since 11 years 2007-2018.In 2013 he got rejected student visa and went under appeal, meanwhile he got work permit visa till 2021. Is he now eligible for ILR under long residence . is the continuity still there or broken because of the rejection in 2013. please guide me

secondly we were filling the form , we undergone some questions regarding our child born in july 2017 they are asking for his nationality and passports, we have not applied for his nationality yet. is it necessary to get him national of pakistan. we are planning once my husband gets ILR our child will get british nationality.

You would need to list ALL his visa categories, approvals, refusals, and appeal dates exactly if you expect any useful advice from strangers on an internet forum.

Hello.

i am eligible to Apply for ILR on 10 years route, before i apply i have few questions.

came to UK in OCT 2007.

23 Aug 2013 i applied for student visa extension which was refused in Nov 2013 due to relying on 3rd party funds to support education went on appeal which continued from lower tribunal to upper tribunal up untill 1st week of Feb 2015. i was offered job on tier 2. withdrew the appeal pending appeal and applied for Tier2 which was approved. got my tier2 extended last year jan 18 with same employer.

my question is how the appeal period would be considered? have i broken continuity?

should i apply for ILR or wait until next year go via tier 2 towards ILR.

Thank you all in advance waiting for expert opinions.

Best Regards.

You are eligible under long residence as the period of appeal comes under section 3C. Overstaying period for before the Tier 2 visa will be disregarded
