SET LR Refused

Dear Sir/Madam,

I applied SET LR in August 2018 and the refused decision was made on 27th Dec 2018. I receive the refusal letter on 31st Dec 2018 stating that I have 14 days to appeal (until 10th January 2019) or I have to leave the country since my last T2 has expired while waiting for this decision.

On the other hand, my prospective employer has prepared a COS for my T2 working visa. I want to carry on with a fresh T2 application instead, should I go ahead and sent out the fresh T2 application before 10th January 2019?

What is your full UK immigration history?

What is or are the exact reasons for refusal of ILR?

How long have you held a tier 2 general visa?

I entered the UK in 2006 with T4 until 2011.

However, my T4 was expired in January 2011 and I overstayed for a month due to an illness (dizziness) and I was not suitable to fly. After a month, when my condition was improved, I went back to Taiwan for the surgery.

I came back to the UK with a fresh T4 in October 2011 until June 2016. and I switched to a DES T4 (Postgraduate Extended Scheme) for a year working. Followed by T2 until 9th September 2018.

I made the SET LR application on 10th August 2018 and it was refused on 27th Dec 2018.

Now I am still in the UK and my employer has prepared a COS for my T2.

My back plan is to carry on with a fresh T2 visa and I will be able to apply the SET LR again in 2021 (from 2011-2021 to avoid the gap in 2011)

Did they return your passport after refusal?

They returned the documents that I used for the application except the passport.
