CHILD BORN IN UK & 10 YEAR LONG RESIDENCE APPLICATION

Hello All.

I'm making an application for my ILR 10Yr , and approaching the 28 day eligibility in the week 3 of Jan.
1.First visited UK in 14Feb2009,as student
2.Then student extension May2012, then PSW till May2014, (All of the applications were made with the Valid until period of the previous visa status )
3.Next changed to Tier 2 General in May 2014 till June 2017
4.Changed employer in April 2015 , however due to an error in the application the application was rejected. After receiving the decision letter and the Documents back, immediately within in a week a New application was made as a Premium service and granted leave from May 2015-till April 2018.
5.Changed employer again in Feb 2016, Grated leave till March 2019. Applied for dependent visa for my spouse in Sep2016 and started living together in UK and since we had a child who is 5months old now. Apart from a Birth Certificate since birth I have not applied for the child's Passport as my plan was to apply for British Passport after my ILR.

Whilst making the application in the Children section, I have answered as below and want to clarify few concerns.

Do you have any children aged 18 years or under who are living in the UK?- Yes
Country of nationality India
Country of Birth UK

In the Documents section, I'm not sure if the below document is mandatory or should I have to write a letter clarifying my intention of applying for British passport, As I do not have BRP or the Passport for the child.

Document(s) showing your child / children's
immigration status such as passports, biometric
residence cards, or vignettes


Also, does having a rejection in my previous visa application have any affect on making the 10 year ILR decision ?

Long residence ILR is granted only to an eligible individual and so there can be no dependants, thus no need to send any of those documents. The refusal should have no effect and will be disregarded under paragraph 39E of the rules

Wow wasn't expecting a reply so quick. Thanks very much Zimba.

Another quick on perhaps, Does this apply true for the Spouse as well? or do I have to take my Spouse passport and BRP card with me to the premium service centre. And also would I have to carry the evidence of relationship with my Spouse and Child ?

Hi, I'm confused with what I should be answering for the Nationality of the Child, born in UK , where both the parents are Indian, is the child naturally indian or does this need to be validated by form of official document?
Since the child does not have any passport/official document with Nationality stated , what should be the answer to this question.?
Also when applying for child's passport would I have to make a MN1 for prior to the passport application.
Or should I go with the S3 form.

Kindly provide with valuable advice.

MN1 form - register the child British citizen then after approval apply for passport

Thanks vpruk, how about the answer I should give on my ILR application for the child Nationality? Is the child by default India citizen?

Child born here acquires parents nationality unless one parent was already British. So your child is Indian but eligible to be registered as British after your ILR
