SET (DV) Information

Hi,
I need to know if someone applies for SET (DV) directly without applying for 3 months discretionary leave to get benefits, and if the partner doesn't inform HO for curtailment of current spouse visa, then what happens ifSET (DV) is refused. Does the original spouse visa leave continues. My actual reason for asking is if the spouse decides to go back to husband after refusal of SET (DV), what is the visa status?
