ILR Qualifying Period for tier 2 Dependent

Hi Anileo45,

Did you managed to get the ILR and when did you applied? Do they calculated the 5 years qualifying period from your grant of visa 21/10/2013 or date of entry to the UK (09/11/2013)?

Please share you experience?

As one of my friend is is due to apply for ILR as a dependant of Tier 2 (General) migrant.

He was granted visa on 11/02/2014 and he entered the UK on 12/05/2014. His leave to remain is due to expire on 21 February 2019. He is just wondering when his 5 years qualifying period starts, from the date of the grant of the visa or entry to the UK. If entry to the UK, then even though he is eligible to apply 28 days before the expiry of his visa, still he is short 1 month and 20 days from completing 5 years.

your quick response would be highly appreciated as the time of the essence and he needs to make a decision weather he needs to apply for an extension to complete 1 month and 20 days before he can apply for ILR or he can apply for ILR straight away.

2. For PBS Dependents, it counts from date of visa issue.

Thank you for your prompt reply CR001 and Sorry I about tagging onto an old topic but I did not know how to post a question and I did want to create a new post as there was an ongoing topic so thought to post the question there.

Also is there any link or policy guidance I can refer to?
