Dear Moderators,
need your help to clarify...

I came as student in July 2006 and got PSW in 2009.
I got my Tier 1 on PBS in 2011 so my Spouse also get dependent visa.
I have applied for ILR on 10 years basis and granted ILR in Sep 2016 and my Mrs granted FLR-M for 2.5 Years.
My Mrs now due for extension in April 2019.

My Question is: should I apply her extension for another 2.5 years or she can apply for ILR now based on settled person and being successfully completed 2 years.

Does Changes to the family immigration rules "if you was granted lave before 9th July 2012" will give any benefit ?

I got British citizenship in Jan 2018 and my kids also hold British Passport.

Your reply will be highly appreciated

regards

KA

She needs a 2.5 year extension. By switching to flr m in 2016, her 5 year ILR clock was reset to zero.

She cannot avail of the pre July 2012 rule as the rules for PBS dependents of ILR long resident applicants changed in April 2014.

Thanks for your prompt reply, also now when filling online application for extension its asking to pay IHS fees for £1000 however My Mrs can qualify for 10 years route in 2020. can we get a refund for example if we just used this IHS 1 year or 1.5 years? or there isnt any refund doesnt matter if you used 1 year or 2.5 years ?

You don't get the Ihs refunded if you apply for ILR. The Ihs website states this clearly.

If it is still a test and test provider on the current HO list then yes it can be used.
