Hi,
I am planing to apply for 10yrs ILR long stay.
I am Thai citizen who came to UK since 2008. I married to Romanian citizen and currently having Family member of EEA citizen status. I have 2 children born in UK ( both have British passports because my husband has ILR). My husband is a self-employed all the time and sending his tax return up to date.

My timeline is
-tier4student 27July2008-03Mar2016
-Family member of EEA 31Mar2016-03Mar2021

I have 4 questions
1. Can EEA family route be counted in 10years ILR?
2. I have 27days gap during the processing time (my student visa expire on 03/03/2016 and they granted EEA fam card date 31/03/2016). Is this matter?
3. I have all copies of my biometric cards of my student visa in each year except in2010-2011 but I have the letter saying that the card will be sent within 10 days (I just lost the copy of that card). Is this matter?
4.Do you think I am qualify for the 10 years ILR long stay or not? And if yes, what supporting documents of my husband need?

1. Yes you can include EEA Family route time provided your EU spouse was a qualified person exercising treaty rights for the whole time you were on the EEA route.

2. What date did you get married and did you marry in the UK??

3. No requirement to submit all BRP cards for 10 years.

4. You need substantial evidence for the whole EEA route time to prove he was a qualified person exercising treaty rights.

Hi Cr001,
Thank you for your super rapidly reply!
You are saving my stress.

Yes,
I married in UK on 05/08/2015.

For question no.4 I am planing to submit
-proof my husband tax return 2015-2018
-his bank statements 2015-2018
-utility bills 2015-2018
-his business invoices 2015-2018
-our married certificate
Do I need to submit his old passport that shown ILR or only the current one?

2. Yes,
I married in UK on 05/08/2015. And then applied for EEA family member in UK. I did not go out of UK during the processing time and never excess 90days a year. The only thing I concern is the date of issue EEA family card is 27days after my student visa expire.

4. I am planing to submit
-proof my husband tax return 2015-2018
-his bank statements 2015-2018
-utility bills 2015-2018
-his business invoices 2015-2018
-our married certificate
Do I need to submit his old passport that shown ILR or only the current one?

You became a family member of an EU national from the date of marriage. Your EEA residence card is not compulsory. Therefore, the dates on it are of less importance.

Is there any financial requirement for ILR 10years long rescidence?

Hi there,
I am applying for ILR 10years long route.
Do I need to show the money in my bank account? If yes, how much please?
I don't see this requirement in the check list but still not sure.
Thank you
