ILR FOR PBS DEPENDENT UNDER SPECIAL CIRCUMSTANCES

Hello,

I would appreciate your guidance please
I have got ILR last year - under tier 2
I wanted to apply for the same for my wife and daughter.
They joined me in UK July 2013, but due to unfortunate medical issue with my mother they went back to India to take care of her for 1.5 years and were back in the UK after 2016
At the time I got my ILR ,I was informed by the officer around that with this situation i could still apply for them under special circumstances and would need to provide the evidence. This case would then be assessed by a senior officer
I wonder if anybody is aware of such a procedure or has undergone the same

There is NO absence limit for PBS dependent visas issued before 11th January 2018.

CR001 has clarified your issue, they can both apply has they have been granted leave before 11th January when the rule changed.

Hello,

I have obtained indefinite leave to remain last year - under tier 2 - 5 year route

Now i am planning to apply for ILR for my spouse and child (they are currently holding a visa which mentions 'PBS LEAVE TO REMAIN)

I am a bit confused about which form to fill - SET O or SET M

I would appreciate your help with this

Form SET(O) is the correct one
